This Terms of Use Agreement sets forth the standards of use of the Online Service. By using the website and/or participating in activities arranged by PickupHub.net you (the “Member”) agree to these terms and conditions. If you do not agree to the terms and conditions of this agreement, you should immediately cease all usage of this website. We reserve the right, at any time, to modify, alter, or update the terms and conditions of this agreement without prior notice. Modifications shall become effective immediately upon being posted at website.
Your continued use of the Service after amendments are posted constitutes an acknowledgement and acceptance of the Agreement and its modifications.
This Agreement may not be amended.
Activity Rules
This is the game and activity rules portion of the agreement:
Member agrees that PickupHub.net is not responsible for Member’s health or condition prior to or during a game and does not collect any information in regards to Member’s health or verify Member’s health. The Member’s health is solely the responsibility of the Member.
Activities are not refundable. If activity is not playable due to weather, amount paid will be credited towards another activity of the persons choosing.
PickupHub.net reserves the right to cancel any activity for any reason and will attempt to notify Members of the cancellation within a reasonable time.
Only Members may participate in an activity. No exceptions. If you cannot make it to an activity, you must cancel your spot prior to the activity.
Hydration and proper nourishment is the responsibility of the member.
Member must respect the rules of the athletic facility or place of activity at all times. This includes no alcohol, violence, littering, use of appropriate equipment, and is not limited to this list. Respect the rules and law at all times.
Reasons for expulsion:
Isolated or consistent disregard for any rules or laws set forth by PickupHub.net administrators or partnerships thereof.
PickupHub.net strives to maintain a friendly and fun atmosphere, making all its activities as great an experience as possible.
Liability Waiver
This portion outlines the Release of Liability waiver portion of the agreement:
Members expressly acknowledge that sports, and in particular activities, involve risk of physical injury greater than those encountered in daily life, and by participating in sports, members acknowledge and assume the risk inherent therein. PickupHub.net accepts no responsibility, and shall not be liable, for any injury, illness, death, damage, loss, accident, expense, delay, or other irregularity resulting from a registered member’s participation in any activity or use of any of the facilities at a PickupHub.net activity. In consideration of being permitted to enter and use PickupHub.net partnered facilities, the member hereby releases, waives, discharges and covenants not to sue any partnered facilities or organizers, its officers, directors, employees, agents, servants and/or assigns for any and all damages, and any claim or demand therefore on account of injury or resulting death of the registered member, of damage to property whether caused by the negligence of PickupHub.net or otherwise while the registered member is participating in activities of PickupHub.net. Additionally, the undersigned hereby authorizes PickupHub.net to utilize the registered member’s name and/or photographic representation in the promotions of the programs of PickupHub.net. Also, each registered member acknowledges the rules of participation and safety of PickupHub.net and agrees to follow all such rules.
Refunds & Credits Policy
This portion outlines the PickupHub.net credit/refund system:
No refunds are given.
If you, the Member, cancel inside the cancellation period, as specified on the activity page, your card will not be charged. If you, the Member, cancel outside of the cancellation period you will lose your payment with no chance of credit, regardless of whether you have read this agreement. The cancellation period is typically 6, 12 or 24 hours from activity start time.
If the activity is cancelled prior to activity start by the host or PickupHub, you will not be charged.
If the activity is cancelled automatically because it has not reached the required participants, any paid participants will be notified and will not be charged.
PickupHub.net may accept lump sum payments from members. These amounts will be credited to the members account with PickupHub.net.
This credit may only be used to buy a spot in an activity and cannot be redeemed for cash, and has no other monetary value.
PickupHub.net will keep these transactions private and will only be visible to PickupHub.net administration and the Member.
When purchasing a spot in an activity, the Member will use their credit if available. When canceling a spot in an activity, the amount of the game will be credited to the Member’s PickupHub.net account.
Website Terms
What Identifying Member Information is Displayed Publicly
Every member has a profile that shows their name, age (unless explicitly hidden by member), and city of residence, as well as past and future activities that the member has participated in on PickupHub.net.
When you, as a member, reserve a position in an activity, your name is displayed on the activity page.
Description of Service
PickupHub.net is providing the Member with information about activities and arranges possible activities for the Member. The Member must provide (1) all equipment necessary for their own Internet connection, including computer and modem and (2) provide for Member’s access to the Internet, and (3) pay any fees related with such connection. (4) His/her own equipment necessary to participate in any activity.
Disclaimer of Warranties
The site is provided by on an “as is” and on an “as available” basis. To the fullest extent permitted by applicable law, makes no representations or warranties of any kind, express or implied, regarding the use or the results of this web site in terms of its correctness, accuracy, reliability, or otherwise. PickupHub.net shall have no liability for any interruptions in the use of this Website. PickupHub.net disclaims all warranties with regard to the information provided, including the implied warranties of merchantability and fitness for a particular purpose, and non-infringement. Some jurisdictions do not allow the exclusion of implied warranties, therefore the above-referenced exclusion is inapplicable.
Limitation of Liability
PICKUPHUB.NET OR ANY OF ITS PARTNERS SHALL NOT BE LIABLE FOR ANY DAMAGES WHATSOEVER, AND IN PARTICULAR SHALL NOT BE LIABLE FOR ANY SPECIAL, INDIRECT, CONSEQUENTIAL, OR INCIDENTAL DAMAGES, OR DAMAGES FOR LOST PROFITS, LOSS OF REVENUE, OR LOSS OF USE, ARISING OUT OF OR RELATED TO THIS WEB SITE OR THE INFORMATION CONTAINED IN IT, WHETHER SUCH DAMAGES ARISE IN CONTRACT, NEGLIGENCE, TORT, UNDER STATUTE, IN EQUITY, AT LAW, OR OTHERWISE, EVEN IF HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Member agrees to indemnify and hold, its parents, subsidiaries, affiliates, officers and employees, harmless from any claim or demand, including reasonable attorneys’ fees and costs, made by any third party due to or arising out of Member’s use of the Service, the violation of this Agreement, or infringement by Member, or other Member of the Service using Member’s computer, of any intellectual property or any other right of any person or entity.
Modifications and Interruption to Service
PickupHub.net reserves the right to modify or discontinue the Service with or without notice to the Member. PickupHub.net shall not be liable to Member or any third party should exercise its right to modify or discontinue the Service. Member acknowledges and accepts that does not guarantee continuous, uninterrupted or secure access to our website and operation of our website may be interfered with or adversely affected by numerous factors or circumstances outside of our control.
Third-Party Sites
Our website may include links to other sites on the Internet that are owned and operated by online merchants and other third parties. You acknowledge that we are not responsible for the availability of, or the content located on or through, any third-party site. You should contact the site administrator or webmaster for those third-party sites if you have any concerns regarding such links or the content located on such sites. Member further agrees not to transmit any material that encourages conduct that could constitute a criminal offense, give rise to civil liability or otherwise violate any applicable local, provincial, national, or international law or regulation.

PickupHub.net retains the right, at our sole discretion, to terminate any accounts involved with botnets and related activities. If any hostnames are used as command and control points for botnets, reserves the right to direct the involved hostnames to a honeypot, loopback address, logging facility, or any other destination at our discretion.
Other Terms
If any provision of this Terms of Use Agreement shall be unlawful, void or unenforceable for any reason, the other provisions (and any partially-enforceable provision) shall not be affected thereby and shall remain valid and enforceable to the maximum possible extent. You agree that this Terms of Use Agreement and any other agreements referenced herein may be assigned by PickupHub.net, in our sole discretion, to a third party in the event of a merger or acquisition. This Terms of Use Agreement shall apply in addition to, and shall not be superseded by, any other written agreement between us in relation to your participation as a Member. Member agrees that by accepting this Terms of Use Agreement, Member is consenting to the use and disclosure of their personally identifiable information and other practices described in our Privacy Policy Statement.
